Terms of Use

1. Definitions

  • ToU: this Terms of Use document.
  • Gingko Lab: the publishing company, a SARL with a share capital of €1,000, registered with the Bordeaux Trade Register under number 947665519, with its registered office at 7 Allée de Chartres, 33000 Bordeaux, France.
  • Application: the Call Blocker mobile application, available for free download from the Google Play Store.
  • User: any person using the Call Blocker mobile application.
  • Google / Play Store: Google company, its subsidiaries, services, and the Android app distribution platform.

2. Purpose

These ToU establish the contractual conditions applicable to the use of the Application by a User.

3. Acceptance

By using the Application, the User fully accepts these ToU. Gingko Lab reserves the right to modify these ToU at any time. Continued use after an update constitutes acceptance of the new terms.

4. Liability and Force Majeure

4.1 Use

Gingko Lab cannot be held liable for misuse of the Application's features or for direct or indirect material damages, including loss of profits. Gingko Lab cannot be held liable for improper functioning due to third-party services or force majeure.

4.2 Access to the Application

The Application is accessible to Users with a compatible Android device. The User is responsible for any internet or mobile fees incurred when using the Application. Gingko Lab cannot be held liable for data loss, intrusions, viruses, or service interruptions related to internet network vulnerabilities. Gingko Lab reserves the right to delete or modify the Application at any time for technical, UX, or legal reasons. Inability to use the Application due to hardware incompatibility cannot give rise to any compensation, except in cases of hidden defect or non-compliance.

5. Features

Call Blocker allows Users to block incoming calls based on personalized settings, including blocking by phone prefix, number range, private numbers, international numbers, and other configurable criteria.

5.1 Blocking

Blocking a number prevents incoming calls from that number from reaching the phone. Blocking only applies if the number is not saved in the phone's contacts. The User can enable or disable blocking settings at any time, including setting specific time slots. Uninstalling the Application also disables blocking.

5.2 Permissions

The use of Google APIs for number identification and blocking grants no additional permissions to the Application. The Application cannot access the User's contacts or call-related information. Only the phone number is analyzed locally within the Application — it is never transmitted to any server.

6. User Data Processing

The Application may collect and process User information only as described in the Privacy Policy. By using the Application, the User accepts this data processing. If the User does not accept the Privacy Policy, they cannot use the Application.

6.1 Data Types and GDPR

None of the data processed by Gingko Lab allows identification of a User. The data is anonymous or anonymized; therefore GDPR texts do not apply to this data.

6.2 Data Usage

All processed data is used solely to improve the Application: fixing crashes, fixing bugs, detecting anomalies, improving performance, and monitoring overall traffic.

6.3 Data Processing

Data processing uses Firebase Services (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Data is not used by third parties and is not resold. Retention is 90 days, up to 14 months for navigation analytics. See the Firebase Terms and Firebase Privacy pages for more details.

7. User Rights and Obligations

The User must comply with applicable laws in their territory. The User agrees not to interfere with the Application (including probing vulnerabilities, installing malware, or using automated data harvesting) and not to exploit the Application's data for personal or commercial purposes.

8. Intellectual Property

All content, software, logos, algorithms, graphics, and databases constituting the Application are the exclusive property of Gingko Lab. These ToU do not grant any transfer of intellectual property rights to the User. Gingko Lab grants the User a non-exclusive, revocable, non-transferable license to use the Application subject to compliance with these conditions.

9. Modifications

Gingko Lab reserves the right to modify these ToU at any time. Users who do not accept certain modifications must immediately cease using the Application.

10. Miscellaneous

If any provision is found illegal or unenforceable, it shall be deemed unwritten without affecting remaining provisions. Claims must be submitted via the in-app contact feature. These ToU are governed by French law. Disputes shall be referred to the competent courts of Bordeaux, absent an amicable resolution.
